Background Summary: Over an extended period of time, the Rules Committee has conducted a comprehensive review of the Association Rules in accordance with Association Procedure Apr 204, Rules Committee. APr 204 provides that one of the responsibilities of the Rules Committee is to review existing rules and regulations, as necessary, to determine relevance and the need for updates and modifications.

Working collaboratively with management and incorporating direction and feedback previously provided by the Association Board of Directors (ABOD), the Rules Committee has completed a thorough review of the Association Rules and developed a series of proposed revisions intended to improve clarity, consistency, accuracy, organization, and ease of understanding for members.

The Rules Committee has completed its review of substantially all sections of the Association Rules. The only section not included in this proposal is the section entitled “Rules in General.” Portions of that section overlap with Association Policy APo 104, which is currently under review by the Policy Committee. As a result, the Rules Committee recommends that updates to that section be considered separately once the Policy Committee completes its review.

The Association Rules have not undergone comprehensive review in several years. The proposed revisions are intended to modernize the document while preserving the original intent of the rules and ensuring consistency with current governing documents, state law, municipal requirements, and operational practices.

Purpose: The purpose of the proposed revisions to the Association Rules is to improve clarity, consistency, and usability of the rules while ensuring they accurately reflect current Association operations, governing documents, and applicable federal, state, and local laws. The proposed revisions update outdated terminology, employee titles, office references, and administrative processes; remove obsolete information; incorporate current legal requirements; clarify maintenance and use responsibilities; improve cross-references to governing documents and policies; and enhances the overall organization and readability of the rules. In addition, certain rules have been updated to address current operational practices, including electronic voting procedures, electric vehicle charging stations, water conservation requirements, hazardous waste disposal, and other matters affecting the health, safety, and welfare of the community.

The proposed revisions are intended to improve member understanding of the Association Rules, promote consistent application and enforcement, and ensure the rules remain relevant and effective in supporting the operation and governance of The Villages Association.

Suggested Motion: Move to approve publication of the proposed revisions to the Association Rules, excluding the section entitled “Rules in General,” for the required member comment period and direct staff to return the proposed revisions to the Association Board of Directors for final consideration following completion of the member comment process.
